If more than one non-combinable offer may apply, Chapie may apply the eligible offer that provides the greater savings, require the customer to select one offer, or limit the transaction to one promotional offer.
Chapie may cancel, adjust, refuse, or correct an order where discounts, credits, shipping offers, membership benefits, or other promotions were combined unintentionally, resulted from a technical error, involved fraud or abuse, or violated these Terms or the applicable offer terms.
Chapie may offer multiple automatically renewing membership tiers, including Chapie VIP and Chapie VIP Gold.
Before enrollment, Chapie will disclose the applicable membership price, billing frequency, free-trial or promotional terms, automatic-renewal terms, benefits, and cancellation method.
Chapie will obtain the customer’s affirmative consent to the applicable automatic-renewal terms before enrolling the customer or charging the customer’s payment method.
A membership that is displayed or provisionally added to a shopping cart does not, by itself, constitute consent. The customer must take a separate affirmative action confirming enrollment before checkout proceeds with the membership included.
Chapie VIP includes a 3-day free trial. Unless canceled before the trial ends, Chapie VIP automatically converts to a paid membership and renews at $9.57 per month, plus applicable taxes, until canceled.

Chapie VIP does not provide a standing percentage discount on every product. Flash-sale pricing applies only to the products, dates, quantities, and terms displayed for the applicable sale.

Cancellation stops future automatic renewals. Unless the customer requests and receives a refund of the current membership charge, benefits will ordinarily remain active through the end of the current paid billing period.
Canceling a membership does not automatically cancel, return, or refund product orders placed while membership benefits were active.
Upon request, Chapie will refund the most recent monthly membership charge for the current billing period, less the measurable value of membership benefits already used during that billing period.

The waived standard shipping value is generally $6.83 per eligible shipment. If the standard shipping charge that would otherwise have applied was different, Chapie may use the actual applicable standard shipping value.
The resulting refund will not be less than $0, and the customer will not owe an additional amount solely because the value of used benefits exceeds the membership charge.
Charges from earlier completed billing periods are non-refundable except where required by applicable law or expressly approved by Chapie.
Chapie memberships are intended for personal, non-commercial use. Membership benefits may not be used for unauthorized resale, wholesale purchases, commercial distribution, account manipulation, fraud, or abuse.
Chapie may restrict, suspend, or terminate membership benefits for payment failure, fraud, resale activity, abusive ordering patterns, misuse of free shipping or discounts, or violation of Chapie’s applicable policies.
Chapie VIP Gold Member Credits may be issued in installments according to the schedule disclosed during enrollment, in the applicable offer, or through the customer’s membership account.
A customer must maintain an active and successfully paid Gold membership to qualify for future scheduled credit issuances. Cancellation does not accelerate the issuance of future credits.
Member Credits are promotional store credits, have no cash value, are non-transferable, and may only be used toward eligible Chapie purchases through the account to which they were issued.
Member Credits cannot be used to purchase or renew a membership, cannot be applied retroactively to completed purchases, and cannot be exchanged for cash except where required by applicable law.
Each issued Member Credit expires 12 months after its issuance date unless a different term is disclosed when issued or expiration is prohibited by applicable law.

Chapie products are designed to help protect eligible lip balms, cosmetics, skincare products, and other compatible items from heat, mess, moisture, dirt, and everyday carry conditions. However, like any consumer product, Chapie has limitations.
While Chapie products are designed to help prevent lip balms and similar products from melting, Chapie does not guarantee absolute protection in every situation. Melting, softening, leaking, product damage, or performance changes may still occur in certain conditions.
Product performance may vary based on several factors, including the type of lip balm, cosmetic, skincare product, or item stored inside; the outside temperature; whether the Chapie is stored in shade or direct sunlight; how long it is exposed to heat; whether it is left inside a vehicle; and other environmental or storage conditions.
Vehicles can become especially hot during the summer and may create conditions that exceed the intended use of certain Chapie products. Chapie Pro is generally better suited for car use than smaller Chapie models, but no Chapie product is guaranteed to prevent melting or damage in every vehicle, temperature, or storage condition.
If a product stored inside a Chapie melts, leaks, softens, or becomes damaged, Chapie is designed to help contain the mess inside the container when used properly. However, Chapie does not guarantee that every mess, leak, stain, or damage will be fully contained or prevented.
Chapie does not issue refunds solely because a lip balm, cosmetic, skincare product, or other item melts, softens, leaks, or becomes damaged inside a Chapie product, unless otherwise required by law or stated in our Return & Refund Policy.
Customers are responsible for confirming that any item they place inside a Chapie product is compatible with the product’s size, intended use, and storage conditions. Chapie is not responsible for damage, spoilage, melting, leaking, reduced effectiveness, or loss of any item stored inside a Chapie product.

You and Chapie each retain the right to bring an individual claim in small claims court if the claim qualifies and remains in small claims court.

To the fullest extent permitted by law, you and Chapie agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, or representative in any class action, class arbitration, private attorney general action, or other representative proceeding.
You and Chapie agree not to participate in or seek to combine individual claims into a class-wide, consolidated, or representative proceeding without the consent of all parties and unless permitted by applicable law.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Service, or when you cease using our site.
