Non-VIP promotional discounts include, but are not limited to, email discount codes, sitewide discount codes, public discount codes, automatic promotional discounts, limited-time sales, influencer codes, affiliate codes, referral discounts, bundle discounts, free gift offers, shipping promotions, and other promotional offers.
If a customer is eligible for both VIP benefits and a non-VIP promotional discount, Chapie may limit the customer to one promotional discount, apply the offer Chapie determines is most appropriate, or require the customer to choose one offer.
Chapie reserves the right to cancel, adjust, refuse, or correct any order where discounts, promotions, credits, shipping offers, VIP benefits, or other offers are combined in a way that was not intended, caused by a technical error, or violates these Terms.
Chapie VIP memberships are billed at $4.99 per month unless otherwise stated.
VIP memberships are subject to the additional terms in our Subscription Policy and Purchase Options Cancellation Policy, including auto-renewal, cancellation, billing, minimum billing terms, benefit reconciliation, and account-management terms.
Active VIP members receive 25% off eligible full-price Chapie products and free standard shipping while their membership is active.
VIP benefits are subject to eligibility requirements, product exclusions, availability, fair-use limits, and any additional terms stated at the time of purchase, enrollment, or use.
Chapie VIP has a minimum billing term of three (3) monthly billing cycles when a member uses VIP benefits during the membership period.
VIP benefits include, but are not limited to, VIP member pricing, discounts, free standard shipping, Member Credits, store credits, access to VIP-only products, early access, exclusive drops, and other member-only benefits.
If no VIP benefits have been used, Chapie may allow immediate cancellation before the end of the minimum billing term.
If VIP benefits have been used and the minimum billing term has not been completed, canceling the membership will stop future auto-renewal after the minimum billing term is completed, unless Chapie approves an early termination option.
Under an early termination option, Chapie may cancel the VIP membership immediately and refund VIP membership fees paid during the applicable membership period, provided that the customer reconciles the VIP benefits used during that period.
Benefit reconciliation may include repayment or deduction of the value of benefits used, including free standard shipping, VIP discounts, member pricing, Member Credits, store credits, VIP-exclusive access, or other VIP savings and benefits used during the membership period.
If a VIP-exclusive product was purchased during the membership period, Chapie may require the VIP-exclusive product to be returned in eligible condition before refunding VIP membership fees or completing early termination.
Chapie may provide a written breakdown or invoice showing the membership fees, benefits used, and any reconciliation amount owed or deducted.
VIP membership fees are non-refundable once billed, except as specifically stated in these Terms, our Return & Refund Policy, our Subscription Policy, our Purchase Options Cancellation Policy, or as required by law. We do not provide refunds, credits, or prorated refunds for partially used billing periods, unused benefits, or canceled memberships.
If a VIP membership is canceled after the minimum billing term has been completed, benefits remain active through the end of the current billing period.
Additional VIP membership terms, cancellation rules, minimum billing terms, benefit reconciliation rules, store credit rules, and subscription terms may be provided in our Return & Refund Policy, Subscription Policy, Purchase Options Cancellation Policy, or other policies posted on our website. By purchasing, enrolling in, or using a VIP membership, you agree to those additional terms.
Store credits and Member Credits have no cash value, are non-transferable, and are not eligible for refunds, cash redemption, or exchange for cash.
Store credits and Member Credits may be used only toward eligible Chapie purchases, subject to the terms stated at the time the credit is issued.
Store credits and Member Credits may not be used to purchase additional VIP memberships, gift cards, or other excluded products unless Chapie specifically states otherwise.
Unused or expired store credits and Member Credits are not refundable. Store credits and Member Credits expire 12 months from the issue date unless otherwise stated.

Chapie products are designed to help protect eligible lip balms, cosmetics, skincare products, and other compatible items from heat, mess, moisture, dirt, and everyday carry conditions. However, like any consumer product, Chapie has limitations.
While Chapie products are designed to help prevent lip balms and similar products from melting, Chapie does not guarantee absolute protection in every situation. Melting, softening, leaking, product damage, or performance changes may still occur in certain conditions.
Product performance may vary based on several factors, including the type of lip balm, cosmetic, skincare product, or item stored inside; the outside temperature; whether the Chapie is stored in shade or direct sunlight; how long it is exposed to heat; whether it is left inside a vehicle; and other environmental or storage conditions.
Vehicles can become especially hot during the summer and may create conditions that exceed the intended use of certain Chapie products. Chapie Pro is generally better suited for car use than smaller Chapie models, but no Chapie product is guaranteed to prevent melting or damage in every vehicle, temperature, or storage condition.
If a product stored inside a Chapie melts, leaks, softens, or becomes damaged, Chapie is designed to help contain the mess inside the container when used properly. However, Chapie does not guarantee that every mess, leak, stain, or damage will be fully contained or prevented.
Chapie does not issue refunds solely because a lip balm, cosmetic, skincare product, or other item melts, softens, leaks, or becomes damaged inside a Chapie product, unless otherwise required by law or stated in our Return & Refund Policy.
Customers are responsible for confirming that any item they place inside a Chapie product is compatible with the product’s size, intended use, and storage conditions. Chapie is not responsible for damage, spoilage, melting, leaking, reduced effectiveness, or loss of any item stored inside a Chapie product.

This arbitration agreement applies to claims based in contract, tort, statute, fraud, misrepresentation, consumer protection, advertising, privacy, text messaging, email marketing, subscription billing, product use, product performance, or any other legal theory.
The arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, unless the parties agree to another arbitration provider. The arbitration will be conducted on an individual basis only.
You and Chapie each retain the right to bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property rights, confidential information, account security, or unauthorized use of the Service.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this arbitration agreement is void or voidable.

You may opt out of this arbitration agreement by emailing support@mychapie.com within 30 days of first accepting these Terms. Your opt-out email must include your full name, email address, order number if applicable, and a clear statement that you wish to opt out of arbitration.
To the fullest extent permitted by law, you and Chapie agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, or representative in any class action, class arbitration, private attorney general action, or other representative proceeding.
You and Chapie agree not to participate in or seek to combine individual claims into a class-wide, consolidated, or representative proceeding without the consent of all parties and unless permitted by applicable law.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Service, or when you cease using our site.
